The conditions that apply to using optimaecm.com. Services are governed by separate agreements.

Effective date: September 17, 2026. These terms govern use of the website only. Consulting services, products, and TotalCare™ are governed by separate written agreements. Draft for review by Optima’s legal counsel before publication.

By accessing optimaecm.com (the “Site”), you agree to these Terms of Use. If you do not agree, do not use the Site.

01Use of the Site

The Site is provided for general information about Optima ECM Consulting, LLC (“Optima”) and its services. You may view, download, and print content for your internal business evaluation. You may not copy, republish, sell, or create derivative works from Site content without our written permission, use automated tools to scrape the Site, or use it in any way that could damage, disable, or impair it.

02Intellectual Property

The Site and its content, including text, graphics, logos, images, the Optima name and mark, and the TotalCare™ mark, are owned by or licensed to Optima and protected by copyright, trademark, and other laws. SAP, SAP Ariba, SAP Taulia, SAP S/4HANA, SAP BTP, and related marks are trademarks of SAP SE. OpenText, VIM, and related marks are trademarks of Open Text Corporation. Other names are the property of their respective owners. Use of partner marks on this Site indicates a partner relationship and not endorsement of this Site’s content.

Insights articles, case studies, and webcasts reflect the views of their authors at the time of publication and are provided for general information. They are not legal, tax, accounting, or investment advice. Results described in case studies are specific to the client and engagement and are not a guarantee of outcomes for others. Statements about partner product roadmaps reflect publicly shared direction and may change; refer to SAP and OpenText documentation when planning.

04Submissions

Information you submit through forms is handled under our Privacy Policy. Do not submit confidential information through the Site; any confidential exchange should take place under a signed non-disclosure agreement.

The Site links to third-party sites and embeds third-party services (for example webcast recordings and LinkedIn). Optima does not control and is not responsible for their content, availability, or practices.

06Disclaimer of Warranties

To the fullest extent permitted by law, Optima disclaims all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

07Limitation of Liability

To the fullest extent permitted by law, Optima and its officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or business, arising from use of or inability to use the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred US dollars.

08Indemnity

You agree to indemnify Optima against claims, losses, and expenses arising from your breach of these Terms or misuse of the Site.

09Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Disputes will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.

10Changes

We may revise these Terms at any time by posting an updated version with a new effective date. Continued use of the Site after changes constitutes acceptance.
